(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 137/2015 registered at Police Station Telibandha, District Raipur for the offence punishable under Section 420 of the Indian Penal Code.

(2) Case of the prosecution, in brief, is that applicant & other co-accused persons are said to have purchased mobile phones by submitting forged Debit Card from Reliance Digital Express

Magneto Mall, Raipur and thereby committed the aforesaid offences.

(3) Counsel for the applicant submits that the applicant has not committed any offence and he has falsely been implicated in the offence in question. He further submits that the applicant has not named in the First Information Report; he is in jail since 19.04.2015; and the charge sheet has already been filed and, therefore, the applicant may be released on bail. (4) On the other hand, counsel for the State opposes the bail application.

(5) Taking into consideration the facts & circumstances of the case; and the manner in which the applicant is said to have purchased mobile phone by submitting forged Debit Card; I am not inclined to release the applicant on bail. Thus, the bail application is rejected.
