The transfer order is under challenge on the ground that it is in violation of policy dated 16.06.2008.

According to the learned counsel for the petitioner, he could be posted only at those places, where there are sports center. It is submitted that earlier in the year 2009, when the petitioner was transfer at Narayanpur, the transfer order was challenged. The said transfer order was quashed by this Court in WPS No.5227/2009 on 14.9.2009 on the ground that the relevant and latest circular dated 16.06.2008 has not been considered. He submits that again, the petitioner

has been transferred from Janjgir-Champa to Kondagaon where there is no training center.

The substantive post of petitioner is Labour Welfare Officer, he has given his duties in the office of Labour Department. The circular dated 16.06.2008 only indicates the places where Center have been opened. There is nothing in the letter to show that officer cannot be posted at a place where there is no sports center. The petitioner cannot claim for his posting at one particular place. He has remained posted at one station since long and now by the impugned order, he has been transferred to another station.

In view of the above, I do not find any merit in the petition. It is dismissed accordingly.
