1. The transfer order is under challenge on the ground that while adjusting another officer at the place where the petitioner is posted, the petitioner has now been transferred to another place. The other ground is that even if an occasion arose for transfer of the petitioner, in view of recent transfer policy, the petitioner should be considered for transfer outside the scheduled area. Reliance is placed on circular dated 3.6.2015 and 11.6.2016.

2. The averments in the petition are that the petitioner has remained posted in the scheduled area ever since 1988. Therefore, according to aforesaid two policies, the respondents are obliged to consider posting of the petitioner to a place outside the scheduled area. Representation has been made to the Director/respondent No.2.

-23. Let a representation be preferred by the petitioner to respondent No.1 within 10 days. The transferring authority shall consider the petitioner's representation for posting him outside the scheduled area as per the transfer policy dated 3.6.2015 and 11.6.2016 within 4 weeks from the date of receipt of representation.

4. With the aforesaid observation/direction, the petition is finally disposed off.
