Shri Varun Sharma, Advocate for the respondent. Last time, the matter came up for hearing on 27.06.2016 on which date also there was no representation on behalf of the appellant and the matter was adjourned to be listed after four months.

The matter is called on for hearing today.

Today also inspite of matter being called twice, on both the occasions, there is no representation on behalf of the appellant. The appeal is preferred against the judgment dated 06.10.2015 passed by the Special Judge (under the Electricity Act), Raigarh, in Special Case No.111/2011 whereby the appellant has been found guilty of having committed offence under Section 138(1)(B) of the Electricity Act and have been ordered to pay an amount of Rs.3000/- as fine with default

stipulation of three month's simple imprisonment, in case of default.

Counsel for the respondent submits that the appellant in the instant case has already deposited the fine amount on 06.10.2015, copy of which is also enclosed along with memo of appeal.

In view of fact that appellant has already deposited the fine amount, it appears that the appellant has lost interest in pursuing the appeal any further as the order under challenge is only in respect of imposition of fine amount and there was no sentence imposed.

Accordingly, the appeal stands dismissed for want of prosecution.
