(2) The Judicial Magistrate First Class, Durg by its order dated 06.06.2013 while considering an application filed by non-applicant No.1 under the Protection of Women from the Domestic Violence Act, 2005, rejected an application filed by the present applicant for exonerating him from the proceeding, against which the appeal was filed under the Act of 2005, which has been dismissed by the impugned order.

(3) Shri T.K. Tiwari, learned counsel appearing for the applicant would submit that the trial Court may be directed to frame an issue on the question raised by the present applicant and may also be directed that the proceeding be disposed of expeditiously looking to the age of applicant.

(4) After hearing learned counsel appearing for the applicant and the finding recorded by two Courts below and looking to the age of the present applicant, who is said to be 75 years old, the trial Court is directed to complete the pleadings of the parties and conclude the same within a period of three months from the date of receipt of copy of this order after framing an issue on the points raised by the parties including the point raised by the applicant herein. (5) With the aforesaid observation, the criminal revision stands finally disposed off.
