Hon'ble Justice Shri Gautam Chourdiya Order on Board 18/11/2020 1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 06/03/2020 in connection with offence under Section 34(2) of the Chhattisgarh Excise Act registered at Police Station Bagbahra, District Mahasamund (C.G.) under Crime No. 46/2020. 2) At the very outset, learned counsel appearing for the applicant, on instructions seeks to withdraw this application with liberty to file a fresh application as and when occasion arises. 3) Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
