The counsel for the applicant after arguing for some time prays for withdrawal of this application with liberty that subject to the applicant surrendering himself before the trial Court and moving an appropriate application for grant of regular bail, the same may be considered on the same day.

Accordingly, the instant application filed under Section 438 Cr.P.C. stands dismissed as withdrawn.

If the applicant surrenders himself before the concerned Court below and moves an appropriate application for grant of regular bail, the same shall be decided by the said Court, if possible, on the same day on its own merits.
