Jitendra Sahu, aged about 28 years, son of Shri Gangaram Sahu, resident of Shivanand Nagar, Sector-3, in front of Vinayak Vihar, Raiipur, Police Station -Khamtarai, Tahsil and District Raipur (C.G.) ----Non-applicant For Applicants :

This criminal revision against refusing of interim maintenance was entertained by this Court on 05/08/2015 and notice was issued but since the matter was fixed for final hearing today, it was reported that service could not be completed therefore, it cannot be heard.

Mr. C.R. Sahu, learned counsel appearing for the applicants would submit that case is fixed for evidence and since the record is requisitioned, the Family Court could not proceed with the evidence therefore, the Family Court be directed to dispose off the case within three months from the date of receipt of certified copy of this order.

Prayer appears to be fair and reasonable.

The Family Court is directed to conclude the proceeding within three months from the date of receipt of certified copy of this order keeping in view the fact that no interim maintenance was granted to the applicants and this revision could not be decided on merit on account of non service to the non-applicant and the matter was remitted looking to the urgency in the matter.

With the aforesaid observation, criminal revision stands finally disposed off.
