1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.225/2015, registered at Police Station Simga, Distt. Balodabazar-Bhatapara, for the offence punishable under Section 34 (2) of the Chhattisgarh Excise Act, 1915.
2. Taking into consideration the nature and gravity of offence, facts and circumstances of the case, the provisions contained in Section 59-A (ii) of the Chhattisgarh Excise Act, 1915, quantity of liquor and previous criminal antecedents of the applicant, I do not consider it a fit case for grant of regular bail to the applicant. The application is rejected. However, the trial Court is directed to expedite the trial and conclude the same as early as possible.
