Sam Koshy Order On Board 31/07/2015 The petitioner in the instant writ petition is aggrieved by the order dated 20.07.2015 whereby she has been transferred from Primary Health Centre, Hanoda to Community Health Centre, Bori, Block Dhamdha, Durg. 2.
Grievance of the petitioner is that her husband is a railway employee and it would be difficult for her husband in getting transfer to the place where she has been presently transferred. According to the petitioner, as per the circular of the Railways, the employees are to be posted as far as possible at the same place where their spouse also is posted. The petitioner has challenged the impugned order on medical ground and has also raised her personal difficulty of having a minor child.

Needless to mention that the law in respect of transfer matters is by now well settled and that this petition also does not reflect any violation of statutory rules
and/or for the service condition. The grievance raised by the petitioner in the instant writ petition can only be considered by the respondent Authorities for which the petitioner is directed to approach the Authorities by making representation. In the event the petitioner makes a representation, the Authority concerned shall decide the same objectively in accordance with the rules. 4.
