1. This revision petition has been brought being aggrieved for the reason that the execution proceeding under Section 125(3) of CrPC is being taken up casually by the learned Family Court, Bilaspur.
2. Considered on the submissions. The petitioner has been granted interim maintenance in M.J.C. No.383 of 2018 by the Family Court, Bilaspur of Rs.60,000/- per month. This maintenance amount has been enhanced by this Court in CRR No.817 of 2018 to Rs.70,000/- per month. As submitted, that the respondent is not making payment of the interim maintenance. The petitioner is patient of chronic kidney disease and she is requirement of funds for undergoing the treatment, therefore, it is prayed that the direction be issued to the learned
Page No.2 Executive Court to expedite the executing proceeding.
3. Considered on the submissions. The learned Executing Court has powers under Section 125(3) CrPC to execute the order by taking coercive steps against the order has been passed. Learned Executing Court is directed to take coercive steps against the respondent in case he is making default in the payment of the interim maintenance to the applicant.
