Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 14/01/2016 Learned counsel for respondents, referring to reply and order dated 18/09/15 (Annexure R/1) submits that representation of the petitioner has been decided.

Learned counsel for the petitioner submits that though representation has been decided, it is after long time and only after issuance of notice of contempt proceedings which shows scorn disregard to the order of this Court. 3.

This Court had directed representation to be decided vide order dated 09/04/13. The order required Commissioner / Director, Directorate, Health Services to decide representation of the petitioner within three months. The representation was made by the petitioner soon thereafter. The respondents have only stated that after scrutiny of the reply, the

order was passed on the representation on 18/09/15. The reason assigned for delay is that the delay was result of slow functioning of State machinery and functionary.

The reasons assigned hardly explains delay. However, considering that representation has been decided and it has been stated that there was no intention to cause delay and apology has been sought, I am not inclined to proceed further in the matter. Rule is therefore discharged. Contempt petition is disposed off with liberty to the petitioner to challenge the order rejecting his representation.
