After arguing for sometime, the learned counsel for the petitioner seeks permission of this Court to withdraw this petition and also prays for issuance of direction.

As the petitioner has submitted that he has filed civil suit against the respondents, which is pending before the learned trial Court and he has also filed an application under Order 39 Rule 1 and 2

of C.P.C., which is pending, therefore, the petitioner is at liberty to prosecute the civil suit and the application filed by him under order 39 Rule 1 and 2 of C.PC.

Accordingly, the writ petition filed under Article 227 of the Constitution of India is dismissed as withdrawn with the liberty as aforesaid.
