1. Heard.

2. The applicant has preferred this second bail application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.01/2020 registered in Police Station Kharora, Dist-Raipur C.G. for the offence punishable under Sections 302, 382, 450, 34 of the IPC.

3. The earlier bail application was dismissed by a detailed order on merits. The present bail application is moved only

MCRC No. 3347 of 2021 on the basis of delay in trial. Due to COVID-19 situation almost all the trials are on hold, therefore, this alone is not a sufficient ground for releasing the applicant. Applicant is accused of committing theft and murder. Delay in trial has to be considered along with nature and gravity of offence.

4. In view of the above, no case for releasing the applicant in this repeat bail application is made out.
