The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.25/2021 registered in Police Station Janjgir, District Janjgir-Champa (C.G.) for offence punishable under sections 323, 376, 450 & 506 of Indian Penal Code. 2.

As per the prosecution case, on 12/01/2021 the applicant in drunken condition asked for water and entered into the house of the prosectrix, thereafter forcefully committed rape and assaulted her. 3.

Learned counsel for the applicant submits that the prosecutrix is aged about 50 years, false allegations have been attributed because of certain dispute and the intervention application has been filed by the prosecutrix wherein she has stated that the applicant may be released on bail.

Learned State counsel do not dispute the fact that application in support of the bail has been filed by the prosecutrix. 5.

Considering the circumstances and the application of the prosecutrix which is in favour of grant of bail, charge sheet has been filed,

applicant is in jail since 14/01/2021, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
