The present Petition arises from the order dated 30.07.2012 whereby the Petitioner was transferred from Government Primary School, Manjhapara to Government Primary School Thadpather.

Learned Counsel for the Petitioner submits that this Court had granted interim protection to the Petitioner on 05.11.2012 and by virtue of the said interim protection he is still continuing at the same place of posting. 3.

Taking into consideration the fact that the Petitioner is continuously working at the said place since year 2012, as a consequence of an interim

order of this Court, this Court thinks it proper to direct the State Government not to act upon the impugned transfer order so far as the Petitioner is concerned. However, there shall be liberty with the State Government to pass a fresh order in case if executive administrative exigency so warrants. 4.
