The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.74/2021 registered in Police Station Khairagarh, District Rajnandgaon (C.G.) for offence punishable under section 67 of the Information Technology Act, 2000. 2.
As per the prosecution case, the applicant prepared some obscene messages of the victim girl and sent it to Naveen Kesharwani with whom she was supposed to be married. Naveen Kesharwani instead showed it to Dinesh Gupta uncle of the victim who made a report. The matter came to fore when the communication was made with the face book and it was found the unique IP address and the mobile number which was used by the applicant on that basis the applicant was arrested. 3.
Learned counsel for the applicant submits that the applicant has been falsely implicated, charge sheet has been filed, he is in jail since 6/03/2021, no further investigation is necessary, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail.

Considering the fact that charge sheet has been filed, nature of allegation and the applicant is in jail since 6/03/2021, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
