• Mr. Pramod Agrawal Chairman, Coal India Limited, Coal Bhawan, Premise No. 04, Mar, Plot No. Af-Iii, Action Area- 1a, Newtown, Rajarhat, Kolkata, (W.B.) 700156 ---- Contemnor For Petitioner :

Mr. Vivek Kumar Agrawal, Advocate Hon'ble Shri Justice Goutam Bhaduri Order On Board 26.05.2020

1. Heard

2. The following effective order was passed by this Court on 27.11.2019 in WPS No. 9782/2019 :- Considering the fact that the petitioner has made a representation (Annexure P-4) which is pending consideration, it is directed that respondent no.1 shall consider and decide the same on its own merits within an outer limit of six months from the date of presentation of this order. It is observed that this Court has not expressed any opinion on the merits of the case.

3. Learned counsel for the petitioner submits that despite the fact that

the posts are vacant, the representation has been cancelled by the Chairman-cum-Managing Director, SECL, therefore, the contempt is made out.

4. The order was passed on 27.11.2019 and it was directed to decide the representation on merits. No specific orders were passed to grant the promotion. In view of this, since the representation has already been decided and dismissed and by order it did not find favour to the petitioner, I do not find any contempt is committed. There is no merit in this contempt petition. Therefore, prima-facie no contempt is made out for issuance of notice at this stage.

5. Accordingly, this contempt petition stands dismissed. Sd/- (Goutam Bhaduri) Judge Vishakha
