At the out set, learned counsel for the petitioner prays that he be permitted to withdraw the instant Cr.M.P. with liberty to file a duly constituted Cr.M.P. as the Police had filed a charge sheet against the petitioner before the Judicial Magistrate First Class, Pithora on a subsequent event i.e. after registration of the FIR and due investigation. 2.

Accordingly, the instant Cr.M.P. is disposed of as withdrawn reserving the aforesaid liberty as prayed for.

The petitioner may file a duly constituted Cr.M.P. in the matter. 4.
