The applicant has filed this bail application under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'the Code') for grant of anticipatory bail, apprehending his arrest in connection with Crime No. 82/2015 registered at Police Station Kunkuri, Distt. - Jashpur for the offence punishable under Sections 420, 467, 468, 471, 409 & 120-B of the Indian Penal Code.

After arguing at length, learned counsel for applicant seeks permission of this Court to withdraw the instant application with liberty to move an application under Section 439 of the Code before the competent Criminal Court.

Accordingly, the instant bail application is dismissed as withdrawn with the aforesaid liberty. However, if the applicant surrenders himself before the trial Court within 20 days from today and files an application under Section 439 of the Code for his release, then if possible, the same shall be heard and decided in accordance with law, on the same day. Certified copy as per rules.
