Shri Maneesh Nigam, counsel appears and submits that at the time when the direction was issued by this Court to decide representation, the authority with all intention could not decide because the State Government had already issued direction that all cases of modification, correction and transfer should be made by the Head of the department, therefore, the matter is required to be decided by the Director Health Services, Chhattisgarh Raipur.

Considering the submission, the contempt petition is finally disposed off. However, it is directed that the order passed by this Court on 28.07.2014 in WP(S) No.3622 of 2014 shall be decided by the Director Health Services, Chhattisgarh Raipur within the time stipulated in the order dated 28.07.2014. The date shall be reckoned from the date of communication of this order to the Director Health Services, Chhattisgarh Raipur. In case, the grievance of the petitioner is not redressed, the petitioner would be at liberty to take recourse to remedy as may be available to him under the law.
