1. The applicant has preferred this application for grant of anticipatory bail, as she apprehends her arrest in connection with Crime No.321/2020, registered at Police Station Baikunthpur, District Koriya for offence punishable under Sections 147, 306, 498-A & 34 of the I.P.C.
2. Present applicant is sister-in-law (nanand) of deceased Arti Khatik who committed suicide by setting herself ablaze on 02.9.2019 and subsequently died in course of treatment on 09.9.2019.
3. Admittedly, co-accused persons have been allowed
MCRCA No. 563 of 2021 anticipatory bail in MCRCAs No.39/2021, 170/2021 and 510/2021.
4. Learned State counsel would oppose the prayer for grant of anticipatory bail.
5. Considering the nature of allegation and the quality of evidence as also release of co-accused persons on anticipatory bail, I am inclined to extend the benefit of anticipatory bail to the applicant.
6. Accordingly, the anticipatory bail application is allowed and it is directed that in the event of arrest of the applicant, she shall be released on anticipatory bail on executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (i)she shall make herself available for interrogation by a police officer as and when required;
(ii)she shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) the applicant shall not influence the witnesses during pendency of the trial.
