1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, in connection with Crime No. 02/2021 for offence under Section 489A, 489B, 489C, 489D, 34 & 201 of IPC, registered at Police StationKotwali, Out Post- CSEB, District- Korba (C.G.).

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file afresh before appropriate Bench as and when occasion arises.

3) Counsel for the State has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the application is dismissed as withdrawn with

the liberty as stated above.
