Learned Pramukh Lokayukt, by its order dated 30.10.2017 (Annexure - P/1), has declined to take cognizance of the complaint filed by the petitioner, against which this writ petition has been filed. 2.

Learned counsel for the petitioner submits that impugned order is unsustainable and bad in law.

I have heard learned counsel for the petitioner and perused the impugned order with utmost circumspection.

On careful perusal it is apparent that the order passed by Revenue Officer/public servant against whom complaint was made has been affirmed by appellate and revisional authority and civil suit filed by petitioner before jurisdictional civil court is pending consideration. In view of aforesaid fact, the Pramukh Lokayukt has declined to entertain the complaint filed by the petitioner, which is neither arbitrary nor perverse. As such, I do not find any jurisdictional error in the impugned order.

The wit petition deserves to and is accordingly dismissed. No cost(s).
