Shri Neeraj Kumar Sharma, Dy GA ------------------------------------------------------------------------------------------ Hon'ble Shri Justice Goutam Bhaduri Order on Board 08.08.2016 1) This is an application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No.314 of 2016, registered at PS Civil Line, Bilaspur (CG) for the offences punishable under Sections 21 and 22 of Narcotics Drugs & Psychotropic Substances Act.

2) Learned counsel for the applicant prays for grant of temporary bail to the applicant as the applicant is suffering from Gangrene on his foot. He submits that the applicant was initially admitted to the CIMS Bilaspur for treatment, but he could not be treated there because of the fact that it is not possible to treat such disease like Gangrene at CIMS Bilaspur and the applicant is aged about 75 years. Therefore, he may temporarily be released for better treatment.

mcrc 4133 of 2016 3) Learned state counsel opposes the bail application, however, does not dispute the situation of the applicant. 4) Heard learned counsel for the parties and perused the record, documents filed along with the application, as also the medical reports of the applicant.

5) Considering the age of the applicant and nature of the disease I am inclined to release the applicant on temporary bail for four months.

6) Accordingly, the prayer for temporary bail is allowed and the applicant is directed to be released temporarily, for a period of four months on bail on his executing a personal bond in sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court. The applicant shall promptly surrender himself before the Court after expiry of four months from the date of release from the jail. 7) Certified copy as per rules.
