1. Petitioner, who is working as ANM in Balrampur-Ramanujganj district, has been transferred from Sub-Health Centre, Girjapur to Sub-Health Centre, Sanawal, Ramanujganj.
2. Learned counsel for the petitioner would submit that petitioner's husband is posted at Middle School, Karmi Kanwartoli, district Balrampur-Ramanujganj, which is very near to the petitioner's present place of posting, however, by the impugned order, the petitioner has been posted to a place which is about 200KM away. He would submit that according to the State Government's policy, insofar as it is possible, husband and wife should be posted at one place or nearby places.
3. In view of the Clause 4 of the State Government's transfer policy dated 1-72015 for the year 2015-16, on the request made by learned counsel for the petitioner, the petitioner is permitted to withdraw the writ petition with liberty to pursue the representation.
4. The authority before whom the representation lies under clause 4 of the transfer policy dated 1-7-2015 shall take the decision in the matter at the earliest, preferably within a period of six weeks from the date of presentation of certified copy of this order.
5. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case.
