1. This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 60/2021 registered at Police StationPithora, District Mahasamund (C.G.) for the offence punishable under Section 20(b) of Narcotic Drugs & Psychotropic Substance Act.

2. As per the prosecution case, on 10.03.2021 when the applicants were traveling by bike bearing No. C.G. 22 P 2747 on being intercepted from the possession of the applicants 6 Kg of Cannabis was recovered.

3. Learned counsel for the applicants submit that the applicants are in jail since 10.03.2021, the charge sheet has already been filed, no further investigation is required, therefore, the applicants may be enlarged on bail.

4. Learned State counsel opposes the prayer for grant of bail.

5. Considering the quantity of Cannabis allegedly seized from the applicants, the charge sheet has been filed and the applicants are in jail since 10.03.2021, I am inclined to release the applicants on bail.

6. Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicants shall be released on bail on furnishing personal bond for a sum of Rs.25,000/- each with one surety each in the like sum to the satisfaction of the concerned trial Court, for their appearance as and when directed.
