This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.106/2015, registered at Police StationSankra, District-Mahasamund (C.G.), for the offence punishable under Section 392 of the IPC.

After hearing learned counsel appearing for the parties and taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence; the manner in which the applicant is alleged to have robbed gold articles and cash from the complainant on 2.7.2014 in National Highway and the fact that bail of co-accused has been rejected in M.Cr.C.No.5082 of 2014 on 10.1.2014, this Court is of the opinion that present is not a fit case, in which, the applicant should be enlarged on regular bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected. However, the trial Court is directed to expedite the trial and conclude the same as early as possible.
