Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 06/08/2021 Heard.

1. Earlier bail application was rejected on merits. This is repeat application for grant of bail.

2. Learned counsel for the applicant would submit that the application has been repeated because number of prosecution witnesses including the relatives have been examined and no credential evidence involving the applicant has been brought on record by the prosecution and the applicant has remained in jail since 07.09.2020. Therefore, at this stage, the applicant may be granted bail.

3. On the other hand, learned State counsel opposes the prayer and submits that the trial is still going on and other material witnesses are yet to be examined.

4. Considering the submission of learned counsel for the parties and further taking into consideration that earlier bail application was rejected by this Court on 29.10.2020, at this stage, present is not a fit case for grant of bail to the applicant. Therefore, the bail application is rejected. However, in case, trial is not concluded within four months, the applicant would be at liberty to revive the application for grant of bail.
