2. Learned counsel for the petitioner submits that the petitioner was apppointed as Shiksha Karmi Grade III on 02.12.2011 and she joined her services on 12.12.2011. She had completed her 8 years
of services on 11.12.2019, thereafter initially a seniority was published by the State on 08.01.2020 inviting objections wherein the name of the petitioner appeared at Sr. No. 65 in the seniority list. Subsequently, vide Annexure P/4 dated 15.01.2020, the Chief Executive Officer, Zila Panchayat Janjgir published a final list wherein the name of the petitioner found missing. Therefore, in these circumstances, the petitioner made a representation on 17.01.2020 so that the grievance of the petitioner about the deletion of his name can be considered.
3. Learned State counsel submits that the list published on 15.01.2020 appears to be not final as it is open to the petitioner and othere persons to make their objections, if any. Under these circumstances, when the petitioner is already in the cadre, and once having joined the post, the name has certainly to be placed somewhere in the seniority list. Therefore, the deletion of the name in the seniority list appears to be an apparent mistake.
4. Consequently, the representation of the petitioner raising the objection regarding deletion of his seniority is to be considered and the name of the petitioner shall be included in the seniority list, according to the Rules.
5. In the opinion of this Court, since the representation has already been filed on 17.01.2020, the same shall be considered and decided by the Chief Executive Officer, Zila Panchayat Janjgir within a period of 90 days from the date of receipt of copy of this order.
6. With the above observations/ directions, the writ petition finally stands disposed off.
