1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.46/2020, registered at Police Station Bagbahara, District Mahasamund, for offence punishable under Section 34 (2) of the Chhattisgarh Excise Act.

2. This application has been filed directly before the High Court without availing the jurisdiction before the Sessions Court, therefore, learned counsel for the applicant seeks permission of this Court to withdraw the bail application with liberty to move before the Sessions Court and thereafter, to move before this Court if eventuality arises.

3. No objection from other side.

4. Accordingly, the bail application is dismissed as withdrawn with the liberty as stated supra.
