Chief Medical And Health Services, Rajnandgaon, DistrictRajnandgaon (Chhattisgarh) ---- Respondent For Petitioner : Shri B.P.Singh, Advocate For Respondent : Shri Shashank Thakur, G.A. for the State Hon'ble Shri Justice Pritinker Diwaker Order On Board 07/08/2015 Challenge in the present petition is to the order dated 20.07.2015 (Annexure P-1) passed by respondent No.3 whereby the petitioner who is working as A.N.M. has been transferred from Sub Health Centre Madiyan, Dongargarh to Sub Health Centre Karelagarh, Khairagarh. Counsel for the petitioner submits that the petitioner is a widow lady having three small children and if compelled to move 150 kms. away from the present place of posting she will suffer an irreparable loss. He submits that the petitioner may be permitted to withdraw this petition with liberty to file representation before the authority concerned in accordance with law. He however submits that till her representation is decided, some protective order may be passed in favour of the petitioner.
State counsel submits that let the petitioner make a representation and
the same would be decided in accordance with law. He however submits that no protective order be passed in favour of the petitioner. Accordingly, the petitioner is permitted to withdraw this petition with the aforesaid liberty. In the eventuality of filing any representation by the petitioner within a period of ten days from today, it is expected from the authority concerned to decide the same within a further period of four weeks from the date of its receipt.
Till four weeks from today, the petitioner shall be allowed to perform her duties in her present place of posting.
