Hon'ble Shri Justice Pritinker Diwaker Order On Board 07/08/2015 Challenge in the present petition is to the order dated 20.07.2015 (Annexure P-1) passed by respondent No.2 whereby the petitioner who is working as Assistant Grade III Forest Range, North Manpur Rajnandgaon to Forest Range, Chowki, Rajnandgaon.

Counsel for the petitioner submits that in his present place of posting the petitioner has joined on 22.12.2014 after being transferred vide order dated 17.12.2014 (Annexure P-2). He submits that for no reasons, the petitioner has been transferred just to accommodate the respondent No.4 who is coming in place of the petitioner on his own request. He submits that he may be permitted to withdraw this petition with liberty to file representation under Clause 4 of the transfer policy. He further submits that till his representation is decided, the operation and effect of the impugned order of

transfer shall be stayed.

State counsel has no objection if he makes any representation and the same is being decided by the authority concerned in accordance with law but he objects that no protective order be passed in favour of the petitioner. Accordingly, the petitioner is permitted to withdraw this petition with the aforesaid liberty. In the eventuality of filing any such representation by the petitioner within a period ten days from today, it is expected from the authority concerned to decide the same within a further period of three weeks from the date of receipt of the same.

Till four weeks from today, the petitioner shall be allowed to perform his duties in his present place of posting.
