This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.201/2010 registered at Police Station-Kondagoan, Distt.Kondagoan (C.G.), for the offence punishable under Sections 363, 366 and 376 of the IPC.

Taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence; further taking note of the fact that the applicant is alleged to have committed sexual intercourse to the minor prosecutrix aged about 15 years and 11 months and also considering the fact that six witnesses have already been examined, this Court is not inclined to release the applicant on regular bail. 3.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is

rejected. However, the trial Court is directed to expedite the trial keeping in view of the fact that the applicant is in jail since 6.9.2010 and conclude the same as early as possible preferably within a period of four months from the date of receipt of certified copy of this order. 4.
