Hon'ble Shri Justice Pritinker Diwaker Order On Board 07/08/2015 Challenge in the present petition is to the order dated 20.07.2015 passed by respondent No.2, whereby the petitioner who is working as Assistant Grade-II has been transferred from the office of District Education Officer, Baloda Bazar to Govt. Girls Higher Secondary School, Simga. Counsel for the petitioner submits that the petitioner is a widow and by the impugned order she has been transferred to a place which is about 55 kms. away from her present pf posting. He submits that the petitioner is residing with her parents and two children who are prosecuting their studies at her present place of posting i.e. at Baloda Bazar. He submits that the petitioner may be permitted to withdraw this petition with liberty to file representation before the competent authority and till then some protective

order may be passed in favour of the petitioner. State counsel submits that let the petitioner make a representation to the competent authority and the same would be decided in accordance with law. He however submits that no protective order be passed in favour of the petitioner.

The petitioner is permitted to withdraw this petition with liberty to file representation. In the eventuality of petitioner filing any such representation within a period of ten days from today it is expected from the authority concerned to decide the same within a further period of three weeks from the date of receipt of the said representation. Till four weeks' from today, the petitioner shall be allowed to perform her duties in her present place of posting.
