Hon'ble Shri Justice Pritinker Diwaker Order On Board 07/08/2015 Challenge in the present petition is to the order dated 20.07.2015 (Annexure P-1) passed by respondent No.2 whereby the petitioner who is working as Headmaster has been transferred from Govt. Primary School, Mohbhatta, block Berla, district Bemetara to Govt. Primary School, Ghoghra, Block Navagarh, district Bemetara.

Counsel for the petitioner submits that the petitioner is due to retire shortly and therefore he ought not to have been transferred. He further submits that the wife of the petitioner is suffering from serious mental ailment and in the facts and circumstances of the case it is difficult for the petitioner to move on the transferred place. He further submits that the petitioner is also suffering from serious ailment and no one has been posted in place of the petitioner. He submits that he may be permitted to withdraw this petition with liberty to file representation and till then the operation and effect of the said order be stayed.

State counsel has no objection so far as filing of representation is concerned but he submits that no protective order be passed in favour of the petitioner.

Accordingly, the petitioner is permitted to withdraw this petition with liberty to file representation. In the eventuality of filing any such representation by the petitioner within a period of ten days from today, the same would be decided by the authority concerned strictly in accordance with law within a further period of four weeks from the date of zsreceipt of the same.
