The applicants have filed this application under Section 438 of the Code of Criminal Procedure, 1973 for grant of anticipatory bail apprehending their arrest in connection with Crime No.08/2018, registered at Police Station Patthalgaon, District Jashpur (C.G.) for the offence punishable under Sections 379, 411/34 of the I.P.C.

Learned counsel for the applicants seeks permission of this Court to withdraw this application with a request that if the applicants surrender before the Court below and file an application under Section 439 of the Cr.P.C. for grant of regular bail, then the same may be heard and decided on the same day.

Accordingly, the application is dismissed as withdrawn. However, if the applicants surrender themselves before the Court below concerned and file an application for their release, the same be heard and decided on the same day, by the concerned Court.
