Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 17/08/2016 Heard on admission.
1. The transfer order is under challenge on the ground that the petitioner is suffering from disability and transfer to another district Ambikapur will result in severe hardship.
2. It is found that the petitioner has remained posted at the present place
-2eversince his initial appointment in the year 2011 and in the exigency of service, he has been transferred.
3. The petitioner has preferred representation to the competent authority, who may consider and decide the petitioner's representation within a period of 4 weeks on its own assessment of the nature and extent of disability and the place where the petitioner has been transferred. If no one has been posted at the place of the petitioner, for a period of 4 weeks, coercive steps shall not be taken against the petitioner on account of non-joining in Ambikapur.
