This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and his no bail application is pending before any other Court.

The applicant has been arrested in connection with Crime No.24/2019 registered in Police Station Sakri, Civil and Revenue District Bilaspur for the offence punishable under Sections 457 & 380 of Indian Penal Code.

Prosecution story in brief is that between 1:00 p.m. of 26.01.2019 to 2:30 a.m. of 27.01.2019 from the Office of Patel Construction situated at Uslapur, some unknown person stole one mobile of Panasonic company, IMEI Nos. 354983091387638 & 3549830931076, cash Rs. 1500/-, silver idols of Lord Ganesh and Laxmi and one motor cycle bearing Registration No.C.G.10-A.P.-7772 from the said office. On the memorandum of applicant, one mobile of Panasonic company bearing same IMEI numbers was seized from him.

Counsel for the applicant submitted that the applicant is innocent and has been falsely implicated in the present case hence he may be released on bail.

Counsel for the State opposed the bail application. However, he submitted that no criminal antecedent against the applicant is reported in police case diary.

Looking to the above mentioned facts and circumstances of the case, the bail application is allowed. It is ordered that if the applicant furnishes two solvent sureties for a sum of Rs.25,000/- along with a personal bond in the sum of Rs.50,000/- to the satisfaction of the concerned Trial Court with the condition that he shall appear before the Trial Court at 11:00 am as and when directed till trial and he would cooperate during the trial, he shall be released on bail and he shall not commit any such type of offence in future.
