The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.75/2016 registered in Police Station Tarbahar District Bilaspur (C.G.) for offence punishable under section 379 of Indian Penal Code.

As per the prosecution case, a report was made by Atul Sharma on 10/03/2016 that he came from Raipur to Bilaspur stayed in a hotel, wanted to go to Chaitma and took a taxi of the applicant who was known to him. Then he went to Chaitma and when came back while he alighted to purchase ticket, at that time the applicant fled away with the taxi and goods wherein Rs.3,50,000/- was kept which was meant for admission of the son of the complainant.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, only cash of Rs.5000/- was recovered from the applicant, no evidence is available against this applicant, he is in jail since 5/04/2016, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the memorandum of the applicant and on the basis of

memorandum other recovery was made from the other co-accused including cash and mobile. Considering the facts of this case, this court is not inclined to release the applicant on bail. 6.
