2. This is the second application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.375/2019 registered at Police Station Kusmunda, District Korba (CG) for the offence punishable under Sections 294, 506B, 147, 148, 149, 427, 307, 302 of the IPC.

3. The earlier bail application was dismissed on merits.

4. In the subject incident, one Sunil Singh was murdered and two other persons were injured.

5. After hearing learned counsel for the applicant, I am not inclined to take any different view of the matter merely because some witnesses have been examined before the trial Court and they have not supported the prosecution.
