The present MCC has been filed seeking extension of time for compliance of the order dated 01.02.2021 passed by this court in WPS No.5574 of 2020. The said writ petition was disposed of directing the respondents-SECL to consider the grievance of the petitioner so far as correction of date of birth of the petitioner-employee is concerned in accordance with provisions of Implementation Instruction No.76 and also keeping in view the report of the Age Determination Committee which were convened on an earlier occasion. The writ petition was disposed of as early as on 01.02.

2021 and the direction was to comply with the order within a period of 60 days. The applicants-SECL have expressed certain difficulties in complying with the order and payed for short extension of time for compliance of the order. According to applicants-SECL within the extended period, the same shall definitely be complied with.

Considering the entire factual matrix of the case and also taking note of the fact that there is still some time left for the non-applicant-employee to retirement even if the service records of SECL is to be accepted, therefore, this court is of the opinion that the applicants-SECL can be granted further extension of time for complying with the order dated 01.02.2021.

Accordingly, the applicants-SECL is directed to ensure that the direction of this court dated 01.02.2021 passed in WPS No. 5574 of 2020 is complied with in its letter and spirit positively within a further period of 45 days. The MCC accordingly stands allowed and disposed of. It is made clear that in case if the applicants-SECL failed to comply with the order of this court within the extended period of time, the non-applicant-employee would be at liberty to initiate appropriate proceedings in accordance with law.
