This is the second application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No.163/2020 registered at Police Station Sariya District Raigarh for the offence punishable under Section 20(B) of the Narcotics Drugs and Psychotropic Substances Act.

The earlier bail application was dismissed with liberty to revive the prayer at an appropriate stage.

These two applicants were found in illicit possession of 13 Kg of contraband (Ganja). They are in jail since 26.9.2020. 5.

Learned counsel for the State would oppose the bail application. However, the concerned SHO has not reported any previous antecedents of the applicants.

Considering the entire facts' situation of the case, this Court is inclined to release the applicants on regular bail. 7.

Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them furnishing a personal bond for a sum of One Lakh with two sureties each in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
