Order On Board 19/08/2015 (1) Criminal Revision Nos. 654 & 174 of 2015, involve common facts and common question of law and, as such, they are being heard analogously and decided by this Common Order. (2) Learned Family Court, by its order dated 15.01.2015 finding that Smt. Sarita Rangari is a married wife of Satish Rangari; Smt. Sarita Rangari is unable to maintain herself; applicant is working as Head Master in the Govt. Middle School and earning 37,364/- per month; and Smt. Sarita Rangari is ₹ having sufficient cause to live separately, has granted 4,000/- ₹ per month as interim maintenance. Against which Smt. Sarita Rangari/wife filed Criminal Revision No.654/2015 for enhancement of interim maintenance whereas Satish Rangari/husband filed Criminal Revision No.174/2015 for reducing the amount of maintenance.
(3) Mr. Minhaj, counsel for the applicant in Cr.R. No. 174/2015 & counsel for the respondent in Cr.R. No. 654/2015 would submit that amount of 4,000/- as interim maintenance granted to Smt. ₹ Sarita Rangari/wife is on the higher side as there is no sufficient reason for her to live separately and, therefore, it deserves to be reduced suitably.
(4) Mr. Gupta, counsel for the applicant in Cr.R. No. 654/2015 & counsel for the respondent in Cr.R. No. 174/2015 would submit that amount of 4,000/- as interim maintenance granted to Smt. ₹ Sarita Rangari/wife is on the lower side and, therefore, it
deserves to the reduced suitably.
(5) After hearing learned counsel for the parties and after going through the material available on record; further considering the inability of Smt. Sarita Rangari/wife to maintain herself; cause shown by her to live separately; and the income of the applicant, who is working as Head Master in Govt. Middle School, as Rs.37,364/- per month, I do not find any illegality in the order impugned and the amount of maintenance is reasonable; it is neither required to be enhanced nor required to be reduced. However, the Family Court is directed to conclude the trial expeditiously preferably within a period of three months from the date of receipt of copy of this order without being influenced by any of the observations made herein as the observation has been made only for the purpose of deciding revision filed against the order granting interim maintenance.
