Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 01/09/2016 The transfer order is under challenge mainly on the ground that the petitioner is going to retire on 31/05/2017 i.e. within a period of less than one year. He submitted that those Government Servants who are going to retire within a period of one year, may be posted either to their home district or to a place of their option as provided in Clause 2.10 of circular dated 11/06/2016. 2.

In view of the aforesaid policy of the Government, claim of the petitioner requires consideration. It is, however, found that the petitioner has filed this petition without preferring any representation.

In view of above, this petition is disposed off with a direction that in case, petitioner prefers representation within a period of 10 days from today, respondent No.2 shall consider petitioner's representation in the light of its own policy and take decision in the matter within a period of three weeks from the date of receipt representation.

For a period of four weeks, no coercive steps shall be taken against the petitioner.
