The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.90/2015 registered in Police Station Mungeli, District Mungeli (C.G.) for offence punishable under section 3/7 of Essential Commodities Act.

As per the prosecution case, the applicant who was running a fair price shop in between the period March 2014 to August 2014, rice, wheat, sugar and grams were misappropriated and thereby Rs.1,73,935/- was misappropriated.

Learned counsel for the applicant submits that the charge sheet has been filed, no further investigation is necessary and incident is of year 2014, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the case diary and the documents. Considering the facts and circumstances of the case, charge sheet has been filed and the applicant is in jail since 13/05/2016, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
