The challenge in the present Writ Petition is to Annexure-P/1 dated 16/02/2018 whereby the claim of the petitioner for grant of compassionate appointment has been rejected.

Perusal of the documents enclosed with the Writ Petition itself would show that, on 29/08/2016, the Government as a policy decision had decided that a compassionate appointment would not be granted to the legal representatives of the deceased employee in the event if one of the family members was in Government employment.

In the instant case, the father of the petitioner undisputedly is in Government employment. The deceased in the instant case was the brother of the petitioner. It is hard to believe that the petitioner whose father is in Government employment and is alive would not be dependent upon him but would be dependent upon her brother.

Given the facts and circumstances of the case this Court does not find any strong case made out by the counsel for the petitioner calling for an interference with the impugned order.

The Writ Petition thus fails and deserve to be and is accordingly dismissed.
