In view of the State Government's instruction dated 2-4-2008 permitting a second appeal before the Commissioner of the revenue Division, against an order
passed by the Collector in respect of service dispute of Aanganbadi Worker, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition. Shri Tripathi would further submit that the petitioner would prefer the appeal at the earliest, therefore, the appellate authority may be directed to consider and decide the same within stipulated time.

In view of the above, the writ petition is dismissed as withdrawn with the aforesaid liberty.

While permitting the petitioner to withdraw the writ petition with the liberty as prayed for, it is directed that in the event the petitioner prefers second appeal before the Commissioner of the concerned Revenue Division within a period of 30 days, the appellate authority shall consider and decide the same, in accordance with law and on its own merits, as early as possible preferably within a period of three months, after hearing all the parties.
