Agrawal Order On Board 10/08/2018 (1) Learned counsel appearing for the petitioner would submit that despite order of this Court passed in Writ Petition No. 1640 of 2016, entire amount of General Provident Fund has not paid, which is Rs. 61,308/-.

(2) Per contra, counsel for respondent No. 2 would submit that after adjusting all the dues, an amount of Rs.14,967/- has already been paid to the petitioner, as such, he is not entitled for any further amount.

(3) I have heard learned counsel appearing for the parties. (4) This Court in Writ Petition No. 1640/2006 has passed the following order:-

"4. Learned counsel appearing for the respondents submits that the amount of General Provident Fund as stated in the letter dated 23-82005 will be paid within a period of two weeks from today. (5) Thereafter, in this writ petition, return has been filed by the Accountant General stating as under:- "(V) The petitioner vide the instant petition has sought payment on the basis of Account Slip. It is humbly submitted that the Account slip issued by the office of the Accountant General are provisional and subject to adjustment of missing credits and debits or any arithmetical mistakes etc. coming to notice during the final payment calculation.

The entire amount is re-calculated from the beginning of the service to the date of retirement, taking into account the details furnished by the department, as per list of drawals and pass book submitted by the department along with the final payment case. A note to this effect is printed in the back of every Accounts Slip for information. Hence, payment desired on the basis of account slip is not acceptable. (VI) Hence, an entire G.P.F. balance of Rs.14,967/- (Rs.12,758 +Rs.2209) has been authorized towards full and final settlement of the case.

(6) After hearing learned counsel appearing for the parties, and after perusing the material available on record, I am satisfied the amount due has already paid to the petitioner i.e. Rs. 14,967/- and, as such, the petitioner is not entitled for any further amount. (7) Accordingly, the writ petition is closed.
