Though, in this case earlier notices were issued, learned State counsel would today apprise the Court that the petitioner has an alternative statutory remedy of filing an appeal to Zila Panchayat. 2.
It is found that the petitioner, aggrieved by non promotion, earlier filed writ petition WPS No. 2413/2016 wherein, order was passed by this Court on 04-08-2016 for consideration of claim for promotion. The Petitioner's representation has been disposed off on 03-05-2017 (Impugned order) in which it has been stated that upon availability of the
post, case of promotion would be considered.

The petitioner has filed this petition disputing the factual statement made in the impugned order and ground raised in the petition is not relating to malafide or in violation of principles of natural justice. 4.
